Allstate, and other insurers, frustrated with the inability or lack of will of state prosecutors to deal with insurance fraud schemes have resulted to filing suit against those participating in the fraud, including the lawyers involved. Much to the surprise of the insurers seeking damages from fraud perpetrators the lawyers seek, and obtain, defense from their errors and omissions insurers. The purpose of the suits claiming lawyers and others committed insurance fraud is to hit them in their bank accounts since the state would not cause them to serve time for the crime.

Although entitled to a defense from Evanston it is not without a remedy. If it properly reserves its rights it can pay for the defense and, if and when Allstate succeeds and obtains a money judgment against the plaintiffs, Evanston can refuse to indemnify the lawyers and obtain a return of all the money it spent defending them since the only way Allstate can succeed is if it proves the plaintiffs acted to defraud Evanston. It can also amend, to avoid the problem in the future, future policies to exclude the obligation to defend any suit where it is alleged that the insured acted fraudulently.
